Terms of use

These terms govern your use of Flush, an app published by Vincent Opitz ("we", "us"). By downloading or using Flush you agree to these terms and to Apple's Licensed Application End User License Agreement (the standard EULA), which also applies and is available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these terms and the standard EULA conflict, these terms govern to the extent permitted.

Subscriptions

Flush offers auto-renewing subscriptions purchased through the App Store:

• Free trial — new subscribers get a 3-day free trial covering 2,000 cleanups. If you don't cancel before the trial ends, it automatically converts into a paid weekly subscription for 20,000 cleanups/week, at the price shown in the App Store before you subscribe.
• Paid plans — weekly subscriptions renew automatically at the price shown in the App Store and in the app (for 20,000 or 50,000 cleanups/week, depending which plan you choose) until cancelled.
• Payment — payment is charged to your Apple ID account at confirmation of purchase, and your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to.
• Managing and cancelling — manage or cancel your subscription any time in your device's Settings → [your name] → Subscriptions, or from Flush's own Settings → Manage subscription, which opens the same Apple-provided screen. Cancelling stops future renewals; you keep access for the rest of the period you've already paid for.
• Refunds — all payments are processed by Apple. Refund requests are handled by Apple under its own refund policies, not by us directly — see Apple's guide to requesting a refund.
• Invite rewards — when 2 invited friends subscribe with your code (after their first paid charge, not a free trial), you get a month of Pro free, with 20,000 cleanups per week. Every 2 more friends add another month, and months run back to back. This is a free Pro period inside Flush, not an App Store subscription: it isn't a payment, can't be exchanged for money or transferred, and you're not entitled to a refund of any kind. It ends when the earned months run out; if you also hold a paid plan, that plan's allowance applies instead, the two aren't added together.

Acceptable use

Flush is provided for your personal use in managing your own photo library. You agree not to reverse engineer, decompile, or attempt to extract the source code of the app except where applicable law expressly permits it; not to use the app in any way that violates applicable law; and not to attempt to interfere with, disrupt, or gain unauthorised access to the referral server or any other systems that support the app.

Deleting photos is your decision

Flush only ever suggests photos to review — it never deletes anything automatically. You choose what to delete, and every deletion goes through Apple's Photos app and lands in Recently Deleted, where it stays recoverable for the period Photos normally keeps deleted items before permanent removal. We are not responsible for photos you choose to delete, including ones that are later permanently removed from Recently Deleted by the passage of time or by your own action in the Photos app.

Disclaimer and limitation of liability

Flush is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the app's photo analysis will be error-free or that it will correctly identify every duplicate, blurry, dark, or low-quality photo, or that it will never flag a photo you'd rather have kept — you're always in control of what actually gets deleted.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data (including photos), arising out of or related to your use of the app, even if we've been advised of the possibility of such damages. Nothing in these terms limits any liability that cannot be limited under applicable law, including in relation to death or personal injury caused by our negligence, or fraud.

Changes to Flush and these terms

We may update the app and these terms from time to time. If we make material changes to these terms, we'll make that clear in the app or on this page. Continuing to use Flush after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you have in your own country of residence.
